Terms and Conditions

1. Parties

These terms govern the relationship between Pixel Digital Lab (service provider, based in Cabo San Lucas, Baja California Sur, Mexico) and the Client (individual or entity contracting the services).

2. Services

Pixel Digital Lab provides web design and development, SEO, Google and Meta advertising, AI-powered process automation, intelligent chatbots, social media management, and digital marketing consulting. The specific scope of each project is defined in the signed proposal or service agreement.

3. Agreement

The service agreement is formed when the Client confirms the proposal in writing (email, WhatsApp, or other digital means) and makes the agreed initial payment. Quotes are valid for 15 calendar days from the date of issue.

4. Payments

  • Prices are quoted in Mexican Pesos (MXN) or US Dollars (USD) as indicated in the proposal.
  • Development projects require a minimum 50% deposit to begin.
  • Recurring services (SEO, advertising, social media) are billed monthly in advance.
  • Payment delays exceeding 10 business days may result in service suspension.

5. Intellectual Property

Upon full payment, the Client acquires usage rights to the final deliverables (designs, code, content) created specifically for them. Pixel Digital Lab retains the right to showcase the work in its portfolio unless a confidentiality agreement is in place. Underlying tools, base templates, and frameworks retain their original licenses.

6. Access to Third-Party Accounts

For advertising and social media management, the Client grants access to their Google, Meta, Instagram, or other platform accounts through each platform's native authorization mechanisms (OAuth, admin access). Pixel Digital Lab will act solely within the scope of the contracted service and will not perform unauthorized actions on those accounts.

7. Client Obligations

  • Provide required information, access, and materials within agreed timelines.
  • Review and approve deliverables within 5 business days of submission.
  • Ensure that provided materials (images, text, logos) do not infringe third-party rights.
  • Maintain valid access and credentials required for service delivery.

8. Limitation of Liability

Pixel Digital Lab does not guarantee specific search engine rankings, conversion rates, or advertising outcomes, as these depend on external factors outside our control. Our maximum liability for any claim shall not exceed the amount paid for the service in the month prior to the event.

9. Cancellation

Either party may cancel recurring services with 30 calendar days' written notice. Development project deposits are non-refundable once work has begun. Monthly service payments are non-prorated once invoiced.

10. Confidentiality

Both parties agree to keep confidential any strategic and commercial information exchanged during the service relationship. This obligation persists for 2 years after contract termination.

11. Governing Law

These terms are governed by the laws of the United Mexican States. Any dispute will be resolved preferably through amicable means; otherwise, the parties submit to the jurisdiction of the competent courts of Los Cabos, B.C.S., Mexico.
